1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Dukaan website, mobile applications, Local Dukaan stores, and all related services (together, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional policies or guidelines referenced here. If you do not agree, you must not use the Platform.
2. Who we are
The Platform is operated by BeyondBorders Limited (“Dukaan”, “Local Dukaan”, “we”, “us”, “our”), a company registered in Ireland.
Dukaan operates as an online marketplace that connects customers with independent vendors who list and sell their products through the Platform.
In addition to the marketplace, Local Dukaan refers to curated online stores and product ranges that are managed and fulfilled directly by BeyondBorders Limited. Products sold through Local Dukaan are sold by BeyondBorders Limited itself, not by third‑party vendors.
3. Your account
To use certain features, you may need to create an account and provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account or security breach.
4. Marketplace role
Dukaan provides a marketplace where independent vendors can offer products for sale to customers.
Unless expressly stated otherwise, Dukaan is not the seller of products offered by third‑party vendors. The contract of sale is between you and the relevant vendor, who is responsible for fulfilling the order and complying with consumer law.
For Local Dukaan products, the seller is BeyondBorders Limited, and we are responsible for fulfilment, delivery, returns, and compliance with applicable consumer laws.
Dukaan may provide support, payment processing, and logistics facilitation but does not accept liability for vendors’ acts or omissions, except where required by law.
5. Placing orders and contract formation
When you place an order on the Platform, you are making an offer to buy products from the relevant seller (either a third‑party vendor or Local Dukaan).
The contract for the sale of goods is formed when the vendor or Dukaan (on the vendor’s behalf) sends you an order confirmation. Vendors may refuse or cancel orders, for example where a product is out of stock, the price was incorrect, or fraud is suspected.
6. Prices, fees, and payments
Product prices, delivery charges, and applicable taxes are displayed on the Platform at the time of ordering.
While we and vendors aim to ensure all prices and information are accurate, errors may occur and orders with obvious pricing mistakes may be cancelled or corrected as permitted by law.
Payments are processed through third‑party payment service providers. Your payment details are handled in accordance with our Privacy Policy and the provider’s terms.

9. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms.
You must not:
- Use the Platform in a way that is unlawful, fraudulent, or misleading
- Interfere with or disrupt the operation or security of the Platform
- Attempt to gain unauthorised access to accounts, systems, or data
- Scrape, copy, or harvest content or data except as allowed by law or these Terms
We may suspend or terminate your access if you breach these Terms or if we reasonably suspect misuse.
10. User content (reviews, comments, etc.)
You may be able to post reviews, ratings, comments, or other content on the Platform.
You are solely responsible for any content you submit and must ensure it is lawful, accurate, not misleading, and does not infringe any third‑party rights.
By submitting content, you grant Dukaan a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, display, and distribute that content in connection with operating and promoting the Platform.
11. Vendor obligations
If you register as a vendor, additional vendor terms apply and form part of these Terms.
Vendors are responsible for:
- Ensuring their listings are accurate, lawful, and not misleading
- Complying with consumer, product safety, tax, and data protection laws
- Fulfilling orders, handling returns, and honouring warranties
Dukaan may suspend or remove vendor accounts or listings in cases of non‑compliance or risk to customers.
Local Dukaan products are not subject to vendor obligations, as they are managed directly by BeyondBorders Limited.
12. Intellectual property
All content and materials on the Platform, including logos, trademarks, text, graphics, software, and designs, are owned by or licensed to BeyondBorders Limited or relevant rights holders.
You may use the Platform and its content only as necessary to browse, purchase, or sell products in accordance with these Terms. Any unauthorised reproduction, distribution, or modification is prohibited.
13. Data protection and privacy
Personal data is collected and processed when you use the Platform. This is described in detail in our Privacy Policy.
By using the Platform, you acknowledge that your personal data will be processed in line with our Privacy Policy and applicable data protection laws.
14. Disclaimers
The Platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error‑free operation.
Product descriptions, images, and specifications are provided by vendors or other third parties. Dukaan does not warrant their accuracy, except where required by law.
Local Dukaan product information is provided directly by BeyondBorders Limited and is maintained with reasonable accuracy.
15. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
Subject to that, and to the maximum extent permitted by law:
- Dukaan’s aggregate liability to you is limited to the greater of:
(a) the total amount paid for the relevant order, or
(b) a reasonable monetary cap specified in the final version of this clause
- Dukaan is not liable for indirect or consequential losses, including loss of profits, revenue, data, or goodwill
16. Indemnity
You agree to indemnify and hold harmless Dukaan and its officers, employees, and agents from claims arising from your breach of these Terms or misuse of the Platform, to the extent permitted by law.
This does not affect your statutory consumer rights.
17. Changes to the Platform and these Terms
We may update or modify the Platform and these Terms from time to time.
Where changes are material, we will take appropriate steps to inform you. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
18. Suspension and termination
We may suspend or terminate your access to the Platform where we reasonably believe you have breached these Terms or created legal or operational risk.
Upon termination, your right to use the Platform ceases immediately, but provisions that should survive will continue to apply.
19. Governing law and jurisdiction
These Terms are governed by the laws of Ireland, without prejudice to mandatory consumer protections in your country of residence.
The courts of Ireland have non‑exclusive jurisdiction, meaning consumers may also bring claims in their local courts where permitted.
